Find A Realtor, LLC, a Virginia limited liability company doing business as Find A Black Agent (the "Company," "FABA," "we," "us," or "our") DOES NOT share customer opt-in information, including phone numbers and consent records, with any affiliates or third parties for marketing, promotional, or any other purposes unrelated to providing our direct services. All text messaging originator opt-in data is kept strictly confidential.

1. Information We Collect

We collect the following types of information:

Personal Information

• Name, email address, phone number, physical address
• Payment information when you make a purchase or request a quote
• Opt-in records and timestamps for all communication channels, including SMS, email, and related communication channels
• For real estate professionals who apply for a listing: license number, licensing state, brokerage affiliation, professional biography, photographs, and service areas

Non-Personal and Technical Information

• IP address, browser type, device information, and approximate geolocation derived from IP address

Customer Communication

• Records of inquiries and service requests, including the type of real estate transaction you are interested in and the market you are interested in

• Verifying the licensure and credentials of real estate professionals who apply for a listing

• Ensuring security and fraud prevention
• Maintaining records of your communication preferences and consent
• Complying with legal, tax, and regulatory obligations

3. SMS Messaging & Compliance

By opting into our SMS messaging services, you agree to receive text messages related to our services, including appointment reminders, customer support, and important updates. The full SMS Messaging Terms & Compliance are set out in Section 10 of our Terms of Service.

Opt-In & Consent

• You will only receive messages if you have explicitly opted in
• We maintain timestamped records of all opt-in actions
• We comply with the Telephone Consumer Protection Act (TCPA) and all applicable laws

Opt-Out Instructions

• You can cancel SMS notifications at any time by replying "STOP"
• You will receive a final confirmation message, and no further messages will be sent unless you re-opt in
• All opt-out requests are processed immediately

Message Frequency & Content

• Message frequency varies based on your interactions with our business
• Messages will be directly related to the services you have requested
• We do not send promotional content without specific consent

SMS Data Protection Statement

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We implement strict data protection measures to safeguard your SMS opt-in information and consent records.

4. Information Sharing & Disclosure

We do not sell or rent personal information to data brokers, and we do not share it for advertising purposes unrelated to the services you have requested. We may share information with:

Real Estate Professionals

• When you request an introduction to a real estate professional listed on the Site, or ask us to match you with one, we share your name, contact information, and the details of your inquiry with that professional so they can contact you
• Real estate professionals who receive your information are independent of the Company and are responsible for their own handling of it

Real Estate Service Partners

• With your permission, we may introduce you to other real estate service partners who can assist with your transaction, such as lenders, title and settlement companies, insurance providers, or moving and home services. When you agree to an introduction, we share your name, contact information, and the relevant details of your inquiry with that partner
• Some partners may pay us a referral or marketing fee. Under certain state privacy laws, sharing your information in exchange for a fee may be treated as a "sale" of personal information, and you may opt out as described in Sections 8 and 9
• We will not introduce you to a partner, or share your information with one, without first obtaining your permission

Service Providers

• Third-party vendors who assist in our operations, such as website hosting, customer relationship management, payment processing, appointment scheduling, email delivery, and analytics
• SMS aggregators and providers solely for the purpose of delivering messages you have consented to receive
• All service providers are contractually obligated to maintain confidentiality and security

Legal Compliance

• If required by law, legal process, or to protect our rights
• In response to valid law enforcement requests or court orders

Business Transfers

• In case of mergers, acquisitions, or sale of assets
• In such cases, your data remains protected under the terms of this policy

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the text message services.

5. Data Retention

We keep personal information only as long as we need it for the purposes described in this policy, and then delete or de-identify it, subject to the exceptions below. Our general retention practices are:

• Account and profile information: for as long as your account or listing is active, and for up to [90] days after you request deletion, to allow removal from the public-facing Site and our systems
• Referral, transaction, and commission records: for [seven (7)] years after the transaction closes or the referral is closed out, to meet tax, accounting, audit, and real estate recordkeeping requirements
• SMS and other communication consent records: for at least [five (5)] years after the consent is withdrawn or the relationship ends, so that we can demonstrate compliance with the TCPA and related laws
• Inquiries, appointment details, and correspondence: for [three (3)] years after our last interaction with you, unless a referral or transaction record requires longer retention
• Website analytics and technical data: in accordance with the retention settings of our analytics providers, generally no more than [26] months
• Information subject to a legal hold, dispute, or regulatory inquiry: until that matter is resolved
• Routine backups and archives: rolled off on our normal backup schedule and not used for any new purpose

When you request deletion of your account under our Terms of Service, we remove your profile and any public listing within a commercially reasonable period, and the retention periods above apply to the records we are required or permitted to keep.

6. Data Security

We implement and maintain reasonable security measures to protect your personal information:

• Encryption of sensitive data in transit and at rest
• Secure access controls and authentication mechanisms
• Regular security assessments and updates
• Employee training on data protection
• Breach notification protocols in accordance with applicable laws
• Secure backup systems and disaster recovery procedures

Despite these measures, no method of transmission over the Internet or electronic storage is 100% secure. We strive to use commercially acceptable means to protect your personal information but cannot guarantee absolute security.

9. Your California Privacy Rights

This Section supplements the disclosures above and applies to California residents.

What we collect and why

We collect identifiers (name, email address, telephone number, postal address, IP address); commercial information about the properties and services you inquire about; internet activity on the Site; professional information from real estate professionals who apply for a listing, including license number and brokerage; approximate geolocation; and inferences used to match you with a real estate professional. We use this information to operate the Site, respond to inquiries, make matches, verify licensure, communicate with you (including by SMS where you have opted in), maintain security, and comply with law. We disclose it to service providers that host the Site, deliver communications, and provide analytics, and to the real estate professional you are matched with or contact. We do not share personal information for cross-context behavioral advertising. With your permission, we may also introduce you to other real estate service partners, such as lenders or title companies, and share your identifiers and the details of your inquiry with them; some of those partners pay us a referral or marketing fee, which may make that disclosure a "sale" of personal information under California law. We do not knowingly sell or share the personal information of consumers under 16 years of age.

Your rights

Subject to verification of your identity, you may request to know, delete, or correct the personal information we hold about you; opt out of the sale or sharing of your personal information, including any introduction to a partner in exchange for a fee, by emailing privacy@FindABlackAgent.com with the subject line "Do Not Sell or Share My Personal Information"; limit our use and disclosure of sensitive personal information; and exercise these rights without retaliation. Submit requests to privacy@FindABlackAgent.com or 844-484-8892. We will respond within 45 days and will tell you if we need up to 45 days more. An authorized agent may submit a request with your written permission.

We are not responsible for their privacy practices and encourage you to review their policies. This Privacy Policy applies only to information collected by the Company.
